Chapter 5.4 - Issuing search warrants
A search warrant authorises police officers to enter and search a place for evidence relating to an offence that has been committed. What a warrant is, and why and how a warrant is issued is described in this chapter of the Duties of Justices of the Peace (Qualified) and Commissioners for Declarations handbook.
This chapter relates to duties which can only be carried out by Justices of the Peace (Qualified).
This chapter should be read in conjunction with Chapter 4.1- Witnessing documents - general procedure and Chapter 4.6 - Administering oaths and affirmations.
